Welcome to yastubo.com (the “Site”). The Site is operated by Yastubo LLC, with address at 131 Continental Dr, Suite 305, Newark, Delaware 19713, United States.
Access to and use of the Site are subject to these Terms of Use. By accessing, browsing or using the Site, the user acknowledges having read, understood and agreed to be legally bound by these Terms. If the user does not agree with them, the user must refrain from using the Site.
1. Purpose of the Site
The Site provides information about membership programs offered by Yastubo LLC and allows users to obtain information or start the subscription process for those programs. The content of the Site is informational in nature and is intended to describe in general terms the services and programs offered by the company.
The Site may also provide access to forms, contact tools or other mechanisms that facilitate the interaction between the user and Yastubo LLC.
2. Nature of the programs offered
The information published on the Site refers to membership programs for international assistance and logistics coordination. These memberships are designed to facilitate access to a coordination network intended to organize and manage certain services related to the international repatriation of human remains from the United States to certain countries.
The specific terms governing the Membership, including activation conditions, operational scope, limitations, exclusions and waiting periods, are set out exclusively in the Membership Agreement, which is provided to the user during the subscription process.
The information contained on the Site does not constitute a contractual offer nor does it replace the terms set out in that agreement.
3. Not insurance or a financial product
The programs described on the Site are membership and assistance programs. Accordingly, they do not constitute insurance policies, indemnity contracts or financial products.
The Membership is limited to providing access to logistics coordination services and to networks of independent providers that may take part in the performance of certain services related to international repatriation.
4. Permitted use of the Site
The user agrees to use the Site solely for legitimate purposes and in accordance with applicable laws. The user agrees not to use the Site in a way that may interfere with its operation, compromise its security or affect other users' access.
Likewise, the user agrees not to attempt to gain unauthorized access to systems, networks or databases related to the Site, nor to introduce malicious code, computer viruses or other elements that may alter its operation.
5. Information provided by the user
The Site may allow the user to provide personal or contact information through forms or similar mechanisms. The user represents that the information provided will be truthful, complete and up to date.
The user acknowledges that Yastubo LLC will not be liable for errors or consequences arising from incorrect, incomplete or inaccurate information provided by the user.
6. Electronic communications
By using the Site or providing contact information, the user agrees that Yastubo LLC may communicate with the user through electronic means in relation to requests made through the Site or with information related to the membership programs offered by the company.
These communications may be made by email, phone calls, messaging or other available electronic means.
7. SMS Messaging Program
By agreeing to receive text messages, you authorize Yastubo to send recurring SMS to the number you provided. Consent is collected in two independent checkboxes: one for service messages (verification codes, payment and renewal reminders, and membership notices) and one for information and promotions. Message frequency varies. Message and data rates may apply. You can cancel at any time by replying STOP; you will receive a single confirmation message and no further messages will be sent. Reply HELP for assistance. Consent to receive SMS is not a condition of purchase.
8. Independent providers
The services that may be coordinated through the membership programs described on the Site may be performed by independent providers that are part of the operating network used by Yastubo LLC.
The role of Yastubo LLC consists of facilitating the logistics coordination of those services within its operating network. The availability and performance of certain services may depend on operational, regulatory or logistical factors that are outside the direct control of the company.
9. Intellectual property
All content on the Site, including texts, designs, logos, graphics, images, software and any other material published on the Site, is the property of Yastubo LLC or its licensors and is protected by applicable intellectual property laws.
No content of the Site may be reproduced, distributed, modified or used for commercial purposes without the prior written authorization of Yastubo LLC.
10. Availability of the Site
Yastubo LLC does not guarantee that the Site will be available continuously or free of errors. The company reserves the right to modify, suspend or discontinue the Site or any of its features at any time and without prior notice.
11. Limitation of liability
To the maximum extent permitted by law, Yastubo LLC will not be liable for direct or indirect damages arising from access to or use of the Site, including service interruptions, technical errors, loss of information or failures in computer systems.
12. Dispute resolution
Any dispute related to the use of the Site will be resolved through binding arbitration, in accordance with the applicable commercial arbitration rules. By accepting these Terms, the user agrees to resolve any dispute outside the ordinary courts.
13. Class action waiver
The user agrees that any claim against Yastubo LLC must be brought individually. The user expressly waives the right to take part in class actions or similar proceedings.
14. Modifications
Yastubo LLC reserves the right to modify these Terms at any time. Modifications will take effect once published on the Site. Continued use of the Site after such modifications will constitute acceptance of the new Terms.
15. Governing law
These Terms will be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
